Judge rules California inmate transfers illegal
A state superior court judge ruled today that Gov. Arnold Schwarzenegger's move to ship thousands of California inmates to out-of-state prisons is illegal, thwarting the governor's only short-term plan to solve the prison overcrowding crisis.

Schwarzenegger called the legal decision a "threat to public safety'' in a statement and said he would appeal.

Judge Gail Ohanesian ruled that Schwarzenegger inappropriately declared a state of emergency in the prison system last fall when he began preparations to send as many as 5,000 inmates to private prisons in states including Oklahoma and Arizona. The judge sided with two unions, including the California Correctional Peace Officers Association, which sued to prevent the transfers.

And what of the health of the inmates that would have been shipped to substandard prisons? Did they give up their right to health upon conviction in $chwarzenneger's Police State Of Kalifornia?
